In a significant ruling, the Rajasthan High Court, presided over by Justice Mr. Farjand Ali, has allowed an application for condonation of a 155-day delay in filing a restoration application, emphasizing that justice should not be thwarted by procedural technicalities. The case involved the State of Rajasthan and Others as petitioners against Nava and Others as respondents.


The court noted that the delay in filing the restoration application for the revision petition, S.B. Civil First Appeal No. 289/2021, was satisfactorily explained. The delay arose from a lack of knowledge about the impugned order, as it was passed without the appellants' notice or opportunity for a hearing. The court held that the limitation period should commence from the date on which the appellants gained knowledge of the order.


The High Court underscored that procedural lapses by counsel should not irreversibly prejudice litigants. The administration of justice should be based on the intrinsic merits of a case rather than being dismissed on trivial or technical grounds. In this instance, the appeal was initially dismissed due to the failure of the appellant's counsel to remove procedural defects within the stipulated time, attributed to an administrative oversight.


Justice Ali emphasized that such procedural irregularities should not annihilate the substantive right of appeal. Any dismissal under such circumstances must be a reasoned and speaking order, reflecting a conscious application of mind to the factual and legal aspects of the case.


In concluding, the court ordered the restoration of the appeal to its original number, directing that it be re-registered and listed for consideration in accordance with the law. This decision highlights the judiciary's commitment to ensuring that justice prevails over procedural formalities, reinforcing the principle that legal processes should serve the ends of justice rather than hinder them.
