Rajasthan High Court Upholds Superintendent of Police's Authority for Further Investigation

Court confirms that SP can direct additional investigations before charge-sheet submission without court permission.


In a pivotal ruling, the Rajasthan High Court, Jaipur Bench, presided by Justice Anoop Kumar Dhand, affirmed the authority of a Superintendent of Police (SP) to direct further investigation before the submission of a charge-sheet, without requiring prior court permission. The judgment was delivered on May 25, 2026, in the case of Taimoor v. State of Rajasthan.


The case stemmed from an FIR registered in January 2019 concerning the unnatural death of Rihana, with allegations of dowry harassment against her husband Shahrukh Khan, mother-in-law Aliman, and others. Initial investigations had not implicated Taimoor, the petitioner, but subsequent orders by SP Alwar led to further investigation, raising questions about procedural propriety.


Justice Dhand highlighted that under Section 173(8) of the Criminal Procedure Code (CrPC), police officers, including superior officers, possess the authority to conduct further investigations without court intervention if no charge-sheet has yet been filed. The court underscored the constitutional mandate for fair investigations as enshrined in Articles 14, 21, and 39A of the Indian Constitution, emphasizing the rights to equality, life, and fair legal processes.


The petitioner, Taimoor, had argued that the further investigation amounted to a re-investigation, which should require court approval. However, the court dismissed these claims, ruling that the SP acted within his legal rights, ensuring the investigation's integrity and quality. The court also noted the absence of any charge-sheet against Taimoor, reinforcing the legitimacy of the ongoing investigation.


Justice Dhand referenced multiple precedents, including Abdul Sattar v. State of Bihar and Subramanian Swamy v. CBI, to support the ruling. The court found no merit in the petition and disposed of it, allowing Taimoor to make representations to the Additional SP for a fair investigation.


This ruling reinforces the procedural autonomy of police authorities in the investigation phase and underscores the judiciary's commitment to upholding constitutional rights during criminal investigations.
