Union of India to Ensure Infrastructure and Jurisdiction Clarity for Trials Involving Organized Crime


In a significant judicial development, the Supreme Court of India has directed the establishment of exclusive Special Courts for the trial of offences under various Central Penal Laws. This directive comes amidst concerns over jurisdictional ambiguities that have been exploited by organized criminals, particularly in the National Capital Region (NCR). The judgment, delivered by Chief Justice Surya Kant and Justice Joymalya Bagchi, emphasizes the Union of India's commitment to providing necessary infrastructure and recurring expenses to facilitate these courts.


The apex court underscored the need for stakeholders to act swiftly, setting a four-week deadline for necessary steps to be initiated. This proactive measure aims to streamline judicial processes and ensure prompt investigation and trial of grave offenses, particularly those involving organized professional criminals who often exploit jurisdictional loopholes.


During the proceedings, the Additional Solicitor General presented documents outlining progress in establishing these courts. Notably, 16 courts have been identified within Delhi, expected to be operational within three months. This move is expected to fortify the judicial system against jurisdictional challenges that criminals exploit, delaying justice.


Furthermore, the judgment draws attention to the need for effective legislation that addresses jurisdictional issues in criminal trials across state boundaries. The court acknowledged the complexities arising when crimes are committed in one state but have legal ramifications in others, which often leads to confusion over which agency should investigate and prosecute.


The court has scheduled a follow-up hearing to review the progress on the establishment of Special Courts and the bail plea of petitioner Mahesh Khatri @ Bholi for January 6, 2026.


This judgment marks a pivotal step in strengthening India's legal architecture, ensuring that organized crime does not benefit from jurisdictional inefficiencies. It sets a precedent for future legislative and administrative reforms aimed at optimizing the country's judicial processes.
