In a recent ruling, the Allahabad High Court granted bail to Furkan, an applicant in a criminal case, while directing the State of Uttar Pradesh to compensate him Rs. 50,000 for wrongful incarceration. The Court found that the police had erroneously submitted Furkan's criminal history, inflating it from five cases to twelve, leading to his extended detention by 15 days.


The judgment, delivered by Justice Arun Kumar Singh Deshwal, highlighted significant procedural lapses and emphasized the need for accurate data handling by law enforcement agencies. Furkan, who was detained under Sections 303(2), 317(2), and 317(4) of the Bharatiya Nyaya Sanhita, 2023, was granted bail after the Court considered the nature of the offense, evidence, and the accused's complicity, along with the issues of overcrowded jails and the heavy pendency of criminal cases.


During the proceedings, it was brought to light that Furkan was falsely implicated based on incorrect records. Despite the State's apology and the acknowledgment of the error as a non-malicious mistake by the Investigating Officer, the Court deemed it necessary to compensate Furkan for the undue hardship caused.


Furthermore, the Court ordered administrative improvements, including the installation of a proper video conferencing setup for effective judicial proceedings and directed the Director Prosecution to ensure adequate staffing to prevent future delays in case handling.


This judgment underscores the judicial system's commitment to upholding justice and accountability, especially in cases of procedural negligence.
