In a significant ruling, the Bombay High Court has set aside the decision of the Railway Claims Tribunal, which had previously rejected a compensation claim related to the death of a bonafide train passenger. The judgment, delivered by Justice Jitendra Jain, acknowledges the death of the appellant's father, Rajani Ravindra, as an "untoward incident" under the Railways Act, 1989, thereby entitling the appellant to a compensation award.


The case revolves around the tragic incident on December 28, 2010, when Rajani Ravindra, traveling with a valid season pass from Nallasopara to Santacruz, fell from a moving train. The appellant, his daughter, sought compensation through the Tribunal, which was denied on grounds that the death did not qualify as an "untoward incident."


The Tribunal's ruling had relied heavily on reports suggesting the deceased was trespassing when hit by an unknown train. However, the High Court identified discrepancies in these reports, including the Station Master's initial report, which did not specify the cause of death. Justice Jain noted that subsequent reports by police and railway authorities were flawed, based on assumptions rather than evidence, ultimately leading to an unjust conclusion by the Tribunal.


Justice Jain emphasized that the Tribunal lacked the expertise to determine the nature of injuries or conclude trespassing without factual evidence. He further rejected the application of Section 147 and Section 124A(c) of the Railways Act, which excludes claims arising from a person's "own criminal act," highlighting the absence of any indication of trespass or criminal activity by the deceased.


The High Court has directed the appellant to submit an application to the respondent authorities for compensation of Rs. 4,00,000, accruing interest at 6% per annum from the date of the accident until realization, subject to a maximum limit of Rs. 8,00,000. Additionally, the court acknowledged the appellant's change in marital status since filing the appeal, directing the authorities to consider her married name for compensation purposes.


The ruling is a landmark judgment that underscores the importance of thorough and unbiased investigation in claims under the Railways Act, ensuring justice for victims and their families.
