Gauhati High Court Cancels Anticipatory Bail Granted Through Misrepresentation

Prasun Banik's Petition Leads to Cancellation of Manna Paul's Bail for Alleged Fraud and Misappropriation of Jewellery

In a significant legal development, the Gauhati High Court has canceled the anticipatory bail previously granted to Manna Paul, a former store manager accused of misappropriating jewellery valued at approximately Rs. 1.34 crore. The decision came after Prasun Banik, Director of Himani Agency Private Limited, filed a petition alleging that the bail was secured through fraudulent means.

Justice Pranjal Das presided over the case, where it was revealed that Paul had misled the court by falsely claiming to have resigned from his position before the jewellery went missing. The investigation uncovered that Paul not only remained employed during the time of the alleged theft but also engaged in further misconduct by taking gold loans on the stolen jewellery and investing in the stock market. The court found that these actions, combined with the fraudulent resignation claim, justified the cancellation of Paul's bail.

The court's decision highlights the legal principle that bail granted through misrepresentation or fraud can be revoked. This ruling reinforces the integrity of judicial processes and emphasizes that misuse of legal provisions will not be tolerated. The case has been sent back to the investigating officers for further action.

Bottom Line:

Anticipatory bail granted by the Sessions Court can be cancelled if it was procured by misrepresentation or fraud.
