Court Orders Ahmedabad Municipal Corporation to Grant Pension to Widow of Deceased Employee, Emphasizing the Validity of Muslim Marriage Without Registration


 In a significant ruling, the Gujarat High Court has directed the Ahmedabad Municipal Corporation to grant family pension to Farzanabanu Mohammadhanif Shaikh, the widow of a deceased employee, despite the absence of her name in the service records and the non-registration of their Nikah Nama. The judgment, delivered by Justice Maulik J. Shelat, underscores the legitimacy of Muslim marriages even when not registered and emphasizes that such technicalities cannot override substantive evidence of marriage.


The petitioner, Farzanabanu, had faced rejection from the municipal corporation on grounds that her marriage was not registered and her name was absent from her late husband's service records. However, the court found these objections arbitrary and unjust, noting substantial documentary evidence supporting the marriage, including a Nikah Nama and an affidavit from the Kazi who solemnized the marriage. The court also referenced a maintenance application in which the deceased employee had acknowledged the marriage.


The court emphasized that the absence of registration or photographs does not invalidate the marriage under Muslim law. It further criticized the corporation's reliance on family objections and absence of documents to deny the pension claim, deeming such actions as arbitrary.


The court ordered the corporation to process the family pension papers and ensure payment of arrears to the petitioner by May 15, 2026, failing which the petitioner would be entitled to interest on the arrears. This decision reinforces the rights of widows to claim pensions and highlights the importance of documentary evidence over procedural technicalities in pension claims.
