The Himachal Pradesh High Court, presided over by Justice Rakesh Kainthla, has overturned the acquittal of Dhruv Dev, initially cleared by the Additional Chief Judicial Magistrate of Palampur, District Kangra, in a rash and negligent driving case. The court convicted Dhruv Dev under Sections 279, 337, and 338 of the Indian Penal Code (IPC) following an appeal by the State of Himachal Pradesh.


The case arose from an accident on November 5, 2010, when Dhruv Dev, driving a car with registration number HP-39B-2236, overtook another vehicle and collided with a motorcycle, causing injuries to the riders. The trial court had previously acquitted Dev, attributing the accident to the motorcyclist's negligence and discrepancies in witness testimonies.


However, the High Court found that the trial court failed to appreciate crucial evidence, including photographs and the site plan, corroborating the prosecution's claim that Dev drove on the wrong side of the road, breaching the Rules of the Road Regulations, 1989. Justice Kainthla highlighted that Dev’s admission of driving the vehicle at the time of the accident, under Section 313 of the Criminal Procedure Code, further supported the prosecution’s case.


The court meticulously analyzed witness testimonies, noting that minor contradictions should not overshadow the credibility of consistent accounts corroborated by photographic evidence. The court emphasized that the relationship of witnesses to the victims did not automatically render their testimonies unreliable, a point underscored by precedents from the Supreme Court.


Justice Kainthla concluded that the trial court's judgment was perverse and unsupported by the evidence, necessitating intervention. The court convicted Dhruv Dev of rash and negligent driving, causing injuries, and scheduled a hearing on March 23, 2026, to determine the sentence.
