Court Overturns Tribunal Decision Allowing Extensions Beyond Statutory Three-Year Limit


In a significant ruling, the Jammu and Kashmir High Court has reinforced the statutory tenure limits for medical positions such as Registrar, Tutor, and Demonstrator in government medical and dental colleges. The court overturned a decision by the Central Administrative Tribunal, which had allowed extensions beyond the prescribed three-year tenure based on the Academic Arrangement Rules, 2020.


The case, involving multiple petitions filed by the Union Territory of Jammu & Kashmir against individuals including Dr. Jyoti Gupta, centered around the interpretation of tenure limits for these academic posts. The respondents, who were initially appointed for periods extendable up to three years, sought further extensions under Rule 4 of the Academic Arrangement Rules, 2020, which the Tribunal had endorsed.


The High Court, however, emphasized that these posts are clearly defined as tenure positions with a maximum duration of three years according to the Jammu & Kashmir Dental Education (Dental College) Gazetted Service Recruitment Rules, 1993, and supported by the National Medical Commission Regulations, 2022. The court noted that extending appointments beyond this period would contravene the statutory provisions and was impermissible under the law.


The ruling highlighted that the Academic Arrangement Rules, 2020, although providing for extensions up to six years, cannot override the statutory rules or extend the tenure of posts beyond the limits fixed by the government. The court stressed that such statutory rules are designed to offer opportunities to more candidates and maintain standards in medical education.


The judgment also clarified the non-faculty status of these positions, reinforcing that they are meant to be stepping stones to faculty roles and not permanent appointments. The decision mandates adherence to the three-year tenure, ensuring compliance with national regulations and the recruitment rules of 1993.
