In a significant judgment, the Jharkhand High Court has ruled that the extension of tenure for Second Members of the Consumer Grievance Redressal Forum (CGRF) must be preceded by a performance evaluation. The decision effectively nullifies Advertisement No. 03/2025 dated August 7, 2025, which sought applications for the posts held by the petitioners, Pramod Kumar and Saket Bihari Saran, without assessing their service records.


The case, presided over by Justice Ananda Sen, revolved around the interpretation of Clause 4.2(2) of the JSERC Regulations, 2020, which governs the tenure and extension of CGRF members. The petitioners, who were serving as Second Members at Ranchi and Chaibasa, challenged the advertisement as an indirect denial of their tenure extension without any performance evaluation. They argued that their service conditions under the JSERC Regulations, 2020 allow for an extension based on satisfactory performance, which was bypassed by Jharkhand Bijli Vitran Nigam Ltd. (JBVNL).


The court highlighted the importance of maintaining the independence and impartiality of CGRF members to uphold the integrity of the grievance redressal mechanism. Justice Sen emphasized that the distribution licensee, JBVNL, cannot unilaterally decide not to extend the tenure of existing members without evaluating their performance, as it compromises the forum's independence.


The court underscored that the JSERC Regulations, 2020 were enacted to create a consumer-friendly system to efficiently address grievances, emphasizing that the term "extendable" in the regulations should be interpreted as mandatory subject to satisfactory service.
