NCLAT Rejects Delay Condonation Plea in Insolvency Appeal

Tribunal Finds Insufficient Grounds for 105-Day Delay in Refiling; Medical Condition of Applicant Accepted, but Coordination Issues Unpersuasive

The National Company Law Appellate Tribunal (NCLAT), Principal Bench, New Delhi, has dismissed an application seeking condonation of a 105-day delay in refiling an insolvency appeal. The application was made by Komal Rakshit Patel in the case against Vinod Tarachand Agrawal and others. The tribunal, headed by Justice Ashok Bhushan and Member (Technical) Barun Mitra, delivered the judgment on February 10, 2025.

The applicant, represented by Advocate Mr. Arjun Sheth, cited coordination issues between the Advocate on Record (AOR) based in Ahmedabad and a clerk situated in New Delhi as a primary reason for the delay. Additional reasons included the applicant's medical conditions and the purported ill health of the clerk. However, the tribunal found the coordination issues unpersuasive and noted that the claimed health issues of the clerk lacked supporting evidence.

While the tribunal acknowledged the medical conditions of the applicant, substantiated by medical reports, it ruled that these did not justify the entire delay period. The tribunal emphasized that geographical separation and routine procedural challenges do not constitute sufficient cause for such a significant delay in legal proceedings.

The Respondents, represented by Advocate Mr. Karan Valecha, opposed the application, arguing that the delay was due to a lack of prompt action by the applicant, who failed to refile a defect-free appeal despite several opportunities.

The tribunal concluded that the applicant did not present sufficient and cogent grounds to justify the delay. Consequently, the application for condonation of delay was rejected, along with the Memo of Appeal, with no costs awarded.

Bottom Line:

Application for condonation of delay in refiling of appeal rejected due to lack of sufficient and cogent grounds. Medical conditions of the applicant considered acceptable, but coordination issues between counsel and clerk and purported ill health of clerk unsupported by evidence were not persuasive.

Statutory provision(s): Not explicitly mentioned in the judgment.
