Court Orders Release of Retiral Benefits with Interest due to Unexplained Delay
In a significant judgment, the Orissa High Court has quashed the departmental proceedings against Bhabagrahi Das, a retired employee, due to inordinate and unexplained delays in the process. The proceedings, which were initiated in 1998, remained unresolved despite Das's retirement on August 31, 1995. The court noted that the delay in concluding the proceedings was not attributable to any fault of the petitioner. As a result, the court directed the State of Odisha to release all pending retiral benefits to Das within three months. Should there be any further delay, the court stipulated that an interest rate of 6% per annum would be applicable on the due amounts.
The judgment highlighted that the prolonged departmental proceedings had caused undue harassment to the petitioner, now 90 years old, who had not received his full retiral benefits except for a provisional pension.
