Patna High Court Dismisses Petition for Sports Quota Appointments

Irregularities in Championship and Documentation Lapses Lead to Cancellation of Ju-Jitsu Athletes' Recommendations

In a significant judgment, the Patna High Court has dismissed a writ petition filed by Ju-Jitsu athletes Bijay Kumar, Chandani Kumari, and Vivek Bhardwaj, who sought appointments as Sub-Inspectors in the Bihar Police under the sports quota. The court upheld the decision of the Bihar State Sports Authority to cancel their recommendations due to irregularities in the organization of the Ju-Jitsu championship and lapses in documentation.

Presiding over the case, Mr. Bibek Chaudhuri, J., emphasized the importance of adherence to procedural fairness and the recognition standards set by the National Sports Federation (NSF). The petitioners had participated in a national championship organized by the Ju-Jitsu Association of India (JAI) and claimed medal achievements. However, the court found that the event's credibility was undermined due to the JAI's failure to renew its national recognition for 2023 and the presence of significant irregularities in the championship's organization.

The petitioners argued that their candidature was unjustly canceled and alleged violations of natural justice due to the non-supply of the enquiry report and absence of show-cause notices. However, the court held that substantial compliance with the principles of natural justice was achieved, providing the petitioners with reasonable opportunities to present their case.

The judgment highlighted the necessity of verifying achievements under the sports quota rules to prevent misuse of public resources. The court dismissed claims of discrimination, noting that the classification was based on intelligible differentia with a rational nexus to the objectives of rewarding genuine excellence.

The court also addressed the doctrine of legitimate expectation, stating that while the initial recommendations created a procedural expectation of fairness, the substantive right to appointment did not arise due to the lack of verifiable national achievements as required by the Bihar Outstanding Sports Persons Direct Appointment Rules, 2023.

In conclusion, the court's decision underscores the need for strict adherence to standards to maintain the credibility of sports events and prevent fraudulent claims under government schemes. The dismissal of the petition reflects a commitment to procedural fairness and public interest over personal claims.

Bottom Line:

Administrative Law - Sports Governance - Claims for employment under sports quota dismissed due to lapses in documentation and irregularities in championship organization, emphasizing adherence to National Sports Federation (NSF) recognition and the importance of procedural fairness.
