Supreme Court dismisses appeal challenging forest land declaration, emphasizing the fiscal nature of revenue records and the jurisdiction of civil courts in land title disputes.


The Supreme Court of India, in a significant ruling on May 6, 2026, dismissed the appeal filed by Vadiyala Prabhakar Rao and others against the Government of Andhra Pradesh regarding the inclusion of 600 acres of land in a forest reserve. The bench, comprising Justices Pankaj Mithal and S.V.N. Bhatti, upheld the government's right to declare the land as forest reserve despite claims of ownership by the appellants, based on revenue records.


The case, originating from a 1950 notification under the Hyderabad Forest Act, involved the proposed declaration of land in Kalvalanagaram Village as reserve forest. The appellants contested the notification, claiming ownership through purported pattas granted in the 1930s. However, the Supreme Court emphasized that revenue records such as Faisal Patti, Vasool Baqi, and Pahanies only serve fiscal purposes and do not confer ownership or title.


The Court reiterated that disputes over land title, especially those involving complex factual and evidentiary matters, must be resolved in civil courts rather than through writ proceedings under Article 226 of the Constitution. The judgment criticized the earlier decision by a single judge which had favored the appellants, noting the improper expansion of judicial review scope.


The Court also clarified that the 1950 notification was valid, despite being issued under a repealed act, as long as it aligned with the provisions of the new act. The appellants' failure to produce original pattas or sufficient evidence of title led to the dismissal of their appeal.


This decision underscores the limitations of revenue records in establishing land ownership and reinforces the role of civil courts in adjudicating title disputes. The judgment also highlights the importance of adhering to procedural norms and the jurisdictional boundaries of different judicial forums.
