Court highlights abuse of legal process in continuing trial amid mutual compromise and lack of intent to prosecute.
In a significant judgment delivered on November 4, 2025, the Telangana High Court, presided over by Justice Smt. Tirumala Devi Eada, quashed the criminal proceedings against Mohd Samiuddin and three others in Crime No.114 of 2025. The case, registered at the Zaheerabad Town Police Station, involved charges under Sections 69 and 318(4) of the Bharatiya Nyaya Sanhita, 2023. The Court's decision came after both parties entered into a Memorandum of Understanding (MoU) resolving their differences amicably.
The petitioner, Mohd Samiuddin, was involved in a consensual relationship with the complainant, who later approached the police due to cultural differences and familial opposition to their engagement. The allegations in the FIR included claims of a physical relationship under false promises of marriage. However, the complainant, a housemaid aged 28, expressed no intent to continue legal proceedings, citing a lack of awareness regarding the legal implications and a desire to move on with her life.
The MoU between the parties, dated September 18, 2025, outlined several terms, including the mutual agreement to delete shared media and to refrain from future contact. Despite initial resistance to the compromise petition, the Court recognized the personal nature of the dispute and the absence of any heinous or serious offense, aligning with precedents from the Supreme Court, notably in the cases of State of Madhya Pradesh v. Laxmi Narayan and Madhukar v. The State of Maharashtra.
The judgment emphasized the futility of continuing the trial, which would not only prolong distress but also burden the judicial system without a productive outcome. The Court concluded that proceeding with the case would constitute an abuse of the legal process, thus allowing the petition to quash the charges against the accused.
Bottom Line:
The Telangana High Court quashed the proceedings against the accused based on a compromise and mutual understanding between the parties, highlighting that continuation of the trial would not serve any meaningful purpose and would be an abuse of process of law.
