Tripura High Court Alters Conviction from Murder to Culpable Homicide in Domestic Dispute Case

The Court reduces the sentence of 76-year-old Bir Manik Jamatia from life imprisonment to eight years for killing his wife during a sudden quarrel.


In a significant judgment, the Tripura High Court has altered the conviction of Bir Manik Jamatia from murder to culpable homicide not amounting to murder, modifying his sentence from life imprisonment to eight years rigorous imprisonment. The division bench comprising Dr. T. Amarnath Goud and S. Datta Purkayastha delivered the verdict in response to an appeal against the September 2022 conviction by the Sessions Judge, Gomati District, Udaipur.


The case revolved around the tragic incident that occurred on September 17, 2020, where Jamatia was accused of killing his wife, Amulya Rani Jamatia, by hitting her on the head with a stick. The altercation, which resulted in the wife's death, stemmed from a strained relationship between the couple, characterized by frequent quarrels and domestic disputes.


During the trial, the prosecution presented 19 witnesses, none of whom were direct eyewitnesses to the incident. The evidence was largely based on extra-judicial confessions and circumstantial evidence. The defense argued that the conviction was primarily based on weak extra-judicial confessions and lacked corroboration from independent witnesses.


The High Court, after a thorough examination of the evidence, concluded that the incident occurred in a fit of rage during a sudden quarrel, with no premeditation or intent to kill. The court emphasized that the absence of clear intent and mens rea to commit murder warranted a re-evaluation of the conviction.


Furthermore, the court considered the appellant's age, 76 years, and the time already served in custody, which exceeded three years, as factors in reducing the sentence. The court's decision underscores the principle that extra-judicial confessions require careful scrutiny and cannot solely form the basis for a conviction without corroborative evidence.


In light of these findings, the court modified the original conviction under Section 302 of the Indian Penal Code to Section 304 Part I, which pertains to culpable homicide not amounting to murder, and adjusted the sentence accordingly.


The judgment highlights the judiciary's role in ensuring that convictions are based on a comprehensive evaluation of the evidence and legal principles, particularly in cases involving severe charges such as murder.
